Commercial Suit

A Commercial Suit is a specialized category of civil lawsuit introduced to fast-track the resolution of high-value business disputes, improving the ease of doing business in India. These suits are governed by the strict, time-bound procedures of the Commercial Courts Act, 2015, rather than the general, slower provisions of the standard CPC.

To qualify as a 'commercial dispute', the lawsuit must involve matters like mercantile documents, export/import of goods, franchising agreements, intellectual property rights, insurance, or joint ventures. Furthermore, the 'Specified Value' of the dispute must be above a certain threshold (currently ₹3 Lakhs at the district level, though higher in some High Courts).

These suits feature mandatory pre-institution mediation (unless urgent interim relief is needed), strict timelines for filing written statements (maximum 120 days, no exceptions), and specialized procedures like 'Summary Judgment' (Order XIII-A) where a judge can decide the case without a full trial if a party has no real prospect of succeeding.

For corporate advocates, navigating the unforgiving deadlines of a commercial suit requires intense preparation, as the courts strictly enforce the forfeiture of the right to file a defense if the 120-day limit is breached.
