Unlawful Association: Section 3 UAPA
An organisation whose activities include 'unlawful activities' (as defined in Section 2(o)) may be declared an 'unlawful association' under Section 3 UAPA by the Central Government by notification. Effect: (a) being a member of the unlawful association is punishable under Section 10 UAPA; (b) supporting or funding the association is punishable; (c) organising meetings for the association is punishable; (d) the association's property may be forfeited. The Review Committee/Tribunal process (Section 4 UAPA) provides limited judicial review of the declaration.

The broad definition of 'unlawful activity' — which includes causing 'disaffection against India' — has been challenged as violating Article 19(1)(a) (freedom of speech and expression). The Supreme Court has upheld the UAPA's definitions as constitutionally valid — but has read them narrowly where possible. In Arup Bhuyan v. State of Assam (2011) 3 SCC 377, the Supreme Court held that mere membership of an unlawful organisation without active participation in violence is protected by Article 19 — active membership with proof of violent activity is necessary for conviction.
