Definition
The act of instigating, conspiring with, or intentionally aiding another person to commit an offence — the abettor is criminally liable even if the principal offence is not ultimately committed.
Section 45 to Section 57 BNS 2023 (formerly Section 107 IPC) talks about Abetment, and consists of three modes: (a) instigation — encouraging, provoking, or commanding another to commit an offence; (b) conspiracy — engaging in a conspiracy with another and an act or illegal omission takes place in furtherance; and (c) intentional aid — facilitating the commission of the offence by any act or illegal omission. . An abettor who was present when the offence was committed may be punished as if they committed the principal offence.
Statutory Definition
Section 45, Bharatiya Nyaya Sanhita (BNS), 2023 (formerly Section 107 IPC): 'A person abets the doing of a thing, who — First — Instigates any person to do that thing; or Secondly — Engages with one or more other persons in any conspiracy for the doing of that thing, if an act or illegal omission takes place in pursuance of that conspiracy, and in order to the doing of that thing; or Thirdly — Intentionally aids, by any act or illegal omission, the doing of that thing. Explanation 1 — A person who, by wilful misrepresentation, or by wilful concealment of a material fact which he is bound to disclose, voluntarily causes or procures, or attempts to cause or procure, a thing to be done, is said to instigate the doing of that thing.'
Etymology & Origin
From Old French 'abeter' (to bait, to incite) from 'a-' (to) + 'beter' (to bait, to provoke). An 'abettor' is one who 'baits' another into action — who provides the provocation, assistance, or conspiracy that leads another to commit the offence.

Abetment: The Crime Behind the Crime
No criminal act exists in a vacuum. Behind many criminal acts is an abettor — the person who encouraged, arranged, or facilitated what happened. The law of abetment holds these persons criminally responsible: not because they committed the act themselves, but because they made it happen through another. From the intellectual author of a murder to the driver who waited outside a robbery, abetment covers a spectrum of secondary participation in crime.
Three Modes of Abetment
(a) Instigation: Urging, provoking, encouraging, or commanding another to commit an offence. Can be by words, gestures, or by wilful misrepresentation (Explanation 1 to Section 45 BNS). Classic examples: a husband instigating a wife to commit suicide (Section 108 BNS — abetment of suicide); a mob leader inciting violence; a person convincing another to file a false complaint. The instigation must be specific, not merely general: 'people like him should be killed' is not necessarily instigation of a specific murder. (b) Conspiracy: Agreement with another to do the thing, plus an act or omission in furtherance. This overlaps with criminal conspiracy (Section 61 BNS) but is narrower — the conspiracy here must result in an act in furtherance before abetment by conspiracy is complete. (c) Intentional aid: Any act or illegal omission that facilitates the commission of the offence. Providing the murder weapon, disabling the CCTV, keeping watch while a robbery is committed — all constitute abetment by intentional aid.
Abetment of Suicide: Section 108 BNS
One of the most litigated abetment provisions is Section 108 BNS (formerly Section 306 IPC) — abetment of suicide. If a person commits suicide and someone's act or omission caused or contributed to the suicide, that person may be charged with abetment. The crucial element is: was there active instigation or such a level of harassment/cruelty that it could foreseeably lead to suicide? Mere domestic quarrel is generally not abetment — there must be a proximate connection between the accused's conduct and the suicide decision.
