Definition

AIS

AIS.

Statement containing financial information of taxpayer.

Statutory Definition

Income Tax Act.

Etymology & Origin

Introduced recently by the Income Tax Department as an upgrade to Form 26AS, designed to provide a comprehensive, 360-degree view of a taxpayer's financial footprint.

Full Legal Analysis

The Annual Information Statement (AIS) is a comprehensive online statement provided by the Income Tax Department to every PAN holder. It aggregates financial information from multiple sources regarding the taxpayer's transactions during a financial year.

Unlike Form 26AS, which primarily focused on TDS and TCS, the AIS goes much further. It includes details of specified financial transactions (SFT) like purchase/sale of immovable property, massive cash deposits, purchase of shares/mutual funds, foreign remittances, and GST turnover data.

Income Tax Act, 1961 — Section 285BB: Empowers the prescribed income-tax authority to upload an annual information statement in the registered account of the assessee.

A key feature of the AIS is the feedback mechanism. If a taxpayer notices a transaction in their AIS that does not belong to them or is duplicated, they can submit online feedback to correct it before filing their return.

[Departmental Procedure]
Information reflected in the AIS forms the primary basis for automated scrutiny and the issuance of notices under Section 148A (reassessment).

For tax professionals, downloading and reconciling the AIS with the client's books of accounts before filing the Income Tax Return is now a mandatory due diligence step to prevent immediate scrutiny notices.
