Form 26AS is an annual consolidated tax statement issued by the Income Tax Department to every PAN holder. It serves as the official proof of tax paid on behalf of the taxpayer by deductors or collectors.
Historically, taxpayers had to collect physical TDS certificates (Form 16/16A) from every deductor. Form 26AS digitized and centralized this. It reflects details of Tax Deducted at Source (TDS), Tax Collected at Source (TCS), Advance Tax paid, Self-Assessment Tax paid, and refunds issued during the financial year.
While the broader Annual Information Statement (AIS) has now been introduced, Form 26AS remains the definitive, legally binding ledger for claiming tax credits. If TDS is not reflected in Form 26AS, the Income Tax portal will automatically deny the credit when processing the return.
While dealing with tax credits, courts have held that the department cannot deny credit to an assessee if the deductor has deducted the tax but failed to deposit it, though the practical remedy requires pursuing the deductor.
Advocates must advise clients that reconciling Form 26AS with their bank statements is the most critical step before filing an income tax return to prevent demand notices.
