State Commission: The Middle Tier

The State Commission occupies the critical middle tier of consumer justice — handling larger consumer disputes (between Rs. 1 crore and Rs. 10 crore) directly, and reviewing the decisions of District Commissions. It brings High Court-level judicial expertise (the President is a former HC judge) to consumer disputes of significant value, providing a reliable appellate check on the district-level decisions.

Real Estate and Insurance: The SCDRC’s Dominant Cases

The SCDRC’s case composition is dominated by: (a) Real estate disputes: Builder defaults on delivery, poor construction quality, refund of booking amounts — where the flat cost typically falls in the Rs. 1-10 crore range. (b) Insurance disputes: High-value insurance claim rejections — life insurance maturity claims, health insurance large claims, marine cargo insurance. (c) Healthcare services: Medical negligence claims of significant value. (d) Banking services: Loan recovery disputes, credit card fraud claims. These case types reflect the SCDRC’s position in the consumer jurisdiction spectrum — big enough to matter financially, small enough for the state-level commission.

Circuit Benches and Accessibility

Some SCDRCs hold circuit benches in major cities within the state to reduce travel burdens on litigants. The CPA 2019’s consumer-resident jurisdiction rule applies at the SCDRC level too — complaints can be filed where the complainant resides or where the cause of action arose, not only at the state capital. This has improved accessibility for consumers in non-capital cities.
